RTS ProtocolTerms of Service
These Terms govern your use of the RTS Protocol website, web app, and iOS app (the “Service”). By using the Service you agree to them. If you do not agree, do not use the Service.
1. What the Service is
RTS Protocol is software that helps sports-medicine and rehabilitation practices (“Practices”) guide athletes through structured return-to-sport rehabilitation: daily readiness check-ins, assigned exercise programs, throwing and workload tracking, movement-video review, and related tools. Accounts are created by a Practice; there is no self-registration.
2. Medical disclaimer — read this
RTS Protocol is not a medical device, does not provide medical advice, and does not practice medicine. Exercise programs, throwing protocols, phase criteria, and clinical notes in the Service are authored and prescribed by your own Practice, not by us. Readiness scores, compliance percentages, and workload ratios (ACWR) are informational calculations from the data you and your Practice enter — they are decision support for your care team, not a diagnosis, treatment, or clearance to play. Never disregard or delay professional medical advice because of something in the Service. If you think you are experiencing a medical emergency, call 911 or your local emergency number immediately. Stop any activity that causes sharp or worsening pain and tell your provider.
3. Accounts and eligibility
- Your account is issued by your Practice. Keep your password confidential; you are responsible for activity under your account. Tell your Practice immediately if you believe your account has been compromised.
- If the athlete is a minor, the account may be used only after a parent or guardian has consented through the Practice, and these Terms are accepted by that parent or guardian on the athlete’s behalf.
- Practices are responsible for their staff’s use of the Service and for their own legal, professional, and record-keeping obligations to their patients.
4. Acceptable use
You agree not to: access data of any athlete or Practice you are not authorized to see; probe, disable, or circumvent security or access controls; upload malware or unlawful content; harass or abuse others in comments; scrape or resell the Service; or use it for any purpose other than rehabilitation care. We may suspend or disable accounts that violate these Terms or threaten the security of the Service.
5. Your content
You (or your Practice) own the videos, comments, and other content you upload. You grant us a limited license to host, store, process (including generating optimized versions of videos), and display that content to you and the authorized members of your Practice, solely to operate the Service. You are responsible for having the right to upload what you upload. We may remove content that violates these Terms. Deleting a video removes the video file and its annotations and comments from the Service.
6. Apple Health
The iOS app can, with your explicit permission, read sleep and nutrition data from Apple Health and attach daily summaries to your record. This is optional, you can revoke it at any time in iOS Settings, and our use of that data is governed by our Privacy Policy, including the commitment that Health data is never used for advertising and never sold.
7. Our property
The Service — its software, design, logos, and text other than user content — belongs to PeopleStar Enterprises, Inc. and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and website for their intended purpose. You may not copy, modify, reverse engineer, or create derivative works of the Service except as the law expressly permits.
8. Availability and changes
We work to keep the Service available and improve it continually, but it is provided without any guarantee of uninterrupted availability. We may add, change, or remove features. If we discontinue the Service materially, we will give Practices reasonable notice so records can be exported.
9. Termination
Your Practice may disable your account at any time; you may stop using the Service at any time; and we may suspend or terminate access for violation of these Terms. Sections 2, 5, 7, and 10–13 survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING SECTION 2, WE DO NOT WARRANT THAT SCORES, CALCULATIONS, OR REMINDERS ARE ERROR-FREE OR SUITABLE AS A BASIS FOR CLINICAL DECISIONS — THOSE DECISIONS BELONG TO YOUR PRACTICE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEOPLESTAR ENTERPRISES, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or your misuse of the Service, except to the extent caused by our own breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Orange County, California, and you consent to their jurisdiction, except that either party may seek relief in small-claims court where eligible.
14. App Store terms
The iOS app is distributed through Apple’s App Store and TestFlight. These Terms are between you and PeopleStar Enterprises, Inc., not Apple. Apple has no obligation to provide support or maintenance for the app, is not responsible for any product claims, and is a third-party beneficiary of these Terms with the right to enforce them against you. Your use of the app must also comply with Apple’s applicable terms of service.
15. Changes to these Terms
If we change these Terms, we will post the new version here with a new effective date and, for material changes, notify Practices. Continued use of the Service after changes take effect constitutes acceptance. The current version always lives at rtsprotocol.com/terms.html.
